1. Acceptance of Terms

By accessing or using WatermarkItPro ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

WatermarkItPro is a web-based application that allows users to apply text and logo watermarks to images. Users can customize watermarks with various fonts, sizes, opacity levels, positions, and rotations. We offer both free and paid subscription plans with varying features and usage limits.

3. User Accounts

To use certain features of the Service, you must create an account via email/password or Google sign-in. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You may update your email address or password through the Account Settings page. Email changes require confirmation via both your old and new email addresses.

4. Subscription Plans

Free Plan: Includes 16 image exports per month (max 2 per day) with text watermark functionality and font selection. Monthly export counts reset on the 1st of each month with no rollover.

Pro Plan ($9/month): Includes unlimited exports, logo watermark support, font selection, saveable presets (up to 3), permanent image storage in your personal Gallery, and all premium features.

Studio Plan ($19/month): Includes everything in Pro, plus batch watermarking (process up to 20 images at once), unlimited saveable presets, priority processing, and ZIP download for bulk exports.

Subscriptions are billed monthly and automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period. After that, your Gallery images will be retained for 30 days before being permanently deleted.

5. Payment Terms

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Prices are subject to change with 30 days notice. No refunds are provided for partial billing periods upon cancellation; access continues until the end of the current billing cycle.

6. Usage Limits

Each plan has defined usage limits. Free users are limited to 16 exports per month and 2 per day. Paid plans include generous usage allowances. We reserve the right to enforce reasonable abuse limits to protect service quality for all users. Attempting to circumvent usage limits may result in account suspension.

7. Acceptable Use

You agree not to use the Service to:

• Upload illegal, harmful, or offensive content
• Infringe on intellectual property rights of others
• Attempt to circumvent usage limits or security measures
• Distribute malware or engage in fraudulent activities
• Resell or redistribute the Service without authorization
• Use automated tools to scrape or abuse the Service

8. Intellectual Property

You retain all rights to the images you upload and the watermarked outputs you create. WatermarkItPro and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.

9. Account Deletion

You may request deletion of your account through the Account Settings page. Account deletion is permanent and cannot be undone. All associated data, including uploaded images, watermark history, saved presets, and personal information, will be permanently removed. If you have an active subscription, it will be cancelled and no refund will be issued for the remaining billing period.

10. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for any loss or corruption of data.

11. Limitation of Liability

To the maximum extent permitted by law, WatermarkItPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
